Sick leave in Spain, which the law calls temporary incapacity, is paid as a share of the regulatory base, that is your contribution base for one month divided by 30. For ordinary illness or a non-work accident the first three days are unpaid, days four to twenty pay 60% and from day 21 you get 75%; days 4 to 15 are paid by the employer and later days by the INSS or a mutua. For a work accident or occupational disease the employer pays the first day's wage and from day two you get 75%. With a €2,100 base, 45 days off with an illness pay €2,026.50 gross. Royal Decree-law 31/2026 changes the base month: for leave starting on or after 1 December 2026 it is the month before the previous one, and for the self-employed already from 21 October 2026. Leave lasts at most 365 days, extendable to 545.

Work accident or occupational disease: the employer pays the full wage for the first day and from day two you get 75%, with no waiting days. Work accidents
Three facts decide almost the whole calculation
The first is the cause of the leave, which is coded on the sick note. An ordinary illness and a non-work accident are paid the same, with three waiting days and the 60 and 75% scale. A work accident, including one on the way to or from work, and an occupational disease are paid from the next day at 75%. On 45 days of leave with a €2,100 base, the gap is €353.50 in benefit alone.
The second is the base. If you are paid a monthly salary and were registered for the whole month, it is divided by 30 even when the month has 31 days, as article 13 of Decree 1646/1972 says; if you are paid by the day or hour, by the days contributed. The contribution base already includes the spread-out share of extra payments, so you do not add them separately. The 2026 ceiling is €5,101.20 a month, set by Order PJC/297/2026.
The third is your collective agreement. The law sets a floor, but 13 of the 21 national agreements we have read top up leave for ordinary illness, usually to 100% of pay for a while. In contact centres, for example, the same 45 days go from €2,026.50 to €2,789.50. Try it with your own case:

€429
| Statutory benefit | €1,062 |
| Employer top-up | €429 |
| Total you receive | €1,491 |
| Without leave you would have earned | €1,800 |
Some cases follow their own rules. The self-employed have no employer days and their mutua pays their contributions from day 61. Anyone who falls ill while on unemployment benefit gets the same amount as the benefit. And a relapse within 180 days of discharge adds the days of the previous leave.

Sick leave explained step by step
What Royal Decree-law 31/2026 changes
Royal Decree-law 31/2026 of 20 October, published in BOE no. 261 on 21 October 2026, rewrites articles 169, 171, 172 and 173 of the General Social Security Act. Its fourth final provision delays those changes to the first day of the second month after publication, 1 December 2026. What you will notice most is the base month: it stops being the month before the leave and becomes the month before that. For leave starting on 10 December, the base will be October's, not November's. If you earned overtime or a pay rise in November, it will not count.
The decree also groups the special situations into five cases: disabling menstruation and pregnancy loss or termination, pregnancy from week 39, organ donation, menopausal disorder and injuries from gender violence. All are paid from the day after the leave starts, with no employer days, and almost all with no prior contributions. For the self-employed, the new article 318.h) applies from 21 October 2026, because it is not among the delayed effects. As of 29 October 2026 we have not found Parliament's validation in the BOE; Congress has thirty working days to vote on it, and if it were repealed we would say so here.

Who pays you and when the money arrives
While you are still employed, sick pay comes through payroll. Days 4 to 15 of an ordinary illness are paid by the employer out of its own pocket. From day 16 the benefit belongs to the INSS or to the mutua your employer uses for temporary incapacity, but the employer keeps advancing it and then deducts it from the contributions it pays in: this is delegated payment under the Order of 13 October 1967. Direct payment, where the body pays you itself, comes when the contract ends during the leave, or when the employer fails to pay. After 365 days, the employer keeps advancing the benefit until discharge or day 545, under article 170.2 of the Act.
That split matters if your employer is small or if you change jobs: it helps to know which band each party owes in order to claim it. The who pays sick leave page goes through it day by day, and the leave calendar puts a date on each change of payer.
How long sick leave can last
Article 169 of the General Social Security Act sets a maximum of 365 days, extendable by another 180 when recovery is expected within that time. At 365 days, control passes to the INSS, which may discharge you, extend the leave or open a permanent incapacity case. At 545 days the benefit ends and the INSS has 90 days to assess your condition, a period it can stretch to 730 days in total if recovery is still under way.
Relapses count: if you are off again with the same or a similar condition within 180 days of discharge, the days are added towards those limits. Leave for disabling menstruation is the exception and always counts as a new process.
Sick notes, reviews and discharge
You no longer hand sick notes to your employer: the doctor gives you a copy and the health service sends the data to the INSS, which forwards it to the employer, as article 7 of Royal Decree 625/2014 says. The same decree sets how often you are reviewed according to the expected length: for leave of 5 to 30 days, after 7 days and then every 14; for leave over 60 days, after 14 days and then every 35.
The mutua may call you to a medical check with four working days' notice and propose your discharge, but only your doctor or the medical inspection signs it. If you miss a check without justifying it within ten working days, you lose the benefit. After 365 days, you have 4 calendar days to contest an INSS discharge. The exact dates for your case are on the leave deadlines page.
Conditions for being paid
To be paid you must be registered with Social Security or in an equivalent situation, such as receiving unemployment benefit, and have a sick note. For ordinary illness you also need 180 days of contributions in the previous 5 years. Accidents, at work or not, and occupational disease require no prior contributions, nor do most special situations. Without those days the sick note is valid, but no benefit is paid. The qualifying period tool tells you whether you meet it.
During the leave you keep contributing and you may not work, either employed or self-employed: doing so lets the paying body suspend or cancel the benefit, under article 175 of the Act. Nor may you refuse the prescribed treatment without good reason.
Why this calculator and not a rule of thumb
The usual sum, base times 60% or 75%, goes wrong in four places that the calculator handles: it takes the base month that matches your leave date, before or after the reform; it splits every day between nobody, the employer and the paying body, with dates; it adds the top-up of the national agreements whose article we have read in the BOE; and it applies the specific rules for the self-employed, work accidents and special situations. The full method, article by article, is on the methodology page.
Common questions
Is anything I type into the calculators sent or stored?
No. The BOE rules and the agreement articles travel inside the page itself and the calculation runs in your browser. There is no account, no form and no database: nothing is sent. If you share the result link, the figures sit in the address and only the person who opens it sees them.
Which contribution base should I enter in the calculator?
The common-contingencies base shown on your payslip, in the bases section. For leave starting before 1 December 2026, the previous month's; from that date, the base of the month before the previous one. The calculator tells you which month applies for the date you enter.
How much do I get for the first month off sick with an illness?
It depends on your base. With €2,100 a month, about 30 days off with an ordinary illness add up to €1,239 gross: three unpaid days, seventeen at 60% and ten at 75%. If your agreement has a top-up, the figure can reach your full pay.
Can I be dismissed while on sick leave in Spain?
Sick leave does not prevent dismissal, but firing someone for being ill can be ruled void as discrimination, and dismissal without cause is unfair. What is fixed is what you receive: if you are dismissed while off with an illness, you keep getting the unemployment rate until discharge and that time is deducted from the benefit.
When does sick leave pass to the mutua or the INSS?
For ordinary illness, from day 16; before that the employer pays. For a work accident, from the day after the leave starts. Even so, while you are still employed you are paid through payroll: the employer advances the benefit and deducts it from its contributions. At 365 days, only the INSS can discharge you.
Is this site run by Social Security or a mutua?
No. It is an independent site published by Radif Partners, which handles no sick notes, manages no benefits and recommends no mutua, lawyer or agency. It publishes free calculators built on the BOE rules and cites every article. The official amount is always set by the body that pays your leave.
