Both national education agreements follow the same pattern: full pay for the first months of leave, whatever the cause, then the statutory benefit only. In publicly funded private schools it is three months at 100% of total pay, plus one month for each three-year service step, and seven months for teachers paid directly by the education authority. In nurseries it is the first three months of any leave at 100% of agreement pay, as long as you are entitled to the Social Security benefit. On a salary of 1800 euros, 120 days off sick at a school with no service steps add up to €6,750; with 3 steps, the same days are paid in full. Once that period ends, the 60 and 75% scale applies.

Publicly funded schools: three months plus one per step

The agreement for private schools funded with public money (BOE-A-2021-15665, article 74) guarantees 100% of total pay during sick leave, including any rises approved while it lasts. It does not distinguish illness from accident. The general period is three months, with one more month at 100% for each three-year service step. Teachers whose salary is paid directly by the education authority get seven months. 7th agreement, in force until the 8th is signed.

The calculator applies the three months of the general case. On €1,800 a month, 120 days off sick give €6,750.00: the first 90 days at full pay and the next 30 at 75% of the base, under Decree 3158/1966. With 3 steps, 180 days of leave add up to €10,800.00, against €9,450.00 with no seniority.

Nurseries: the first three months

The agreement for nursery and early-years centres (BOE-A-2025-11289, article 38) covers the first three months of any leave at 100% of monthly agreement pay: base salary, personal supplement and seniority, without the extra payments. It requires you to be entitled to the Social Security benefit, so if you do not meet the qualifying period for ordinary illness there is no top-up either. 13th agreement, to 2027.

On €1,800, a 30-day leave pays €1,800.00; a 120-day leave, €6,750.00, because the last month goes back to the statutory benefit.

After the agreement period

When the months at 100% run out, you receive the temporary incapacity benefit: 75% of the regulatory base once you have been off for more than 20 days. For a teacher with a €1,800 base, that is €45.00 a day. Leave can last up to 365 days and be extended by 180 more, as the maximum length page explains. Regional education agreements and school-level arrangements can be more generous: if yours is, its text prevails.

Common questions

How many months of full sick pay does a publicly funded school teacher get?

It depends on who pays you. If the education authority pays your salary directly, article 74 gives seven months. If the school pays you, three months plus one for each three-year service step: with 3 steps, 6 months. After that you receive the Social Security benefit only, at 75% of the base.

Does a nursery pay sick leave from the first day?

Yes. Article 38 of the nursery agreement covers the first three months of any leave at 100% of agreement pay, including days 1 to 3 that the law leaves unpaid. On 1800 euros a month, 30 days of leave pay €1,800, against €1,062 from the statutory benefit alone.

Which pay items does the nursery agreement guarantee?

Base salary, the personal supplement and seniority, without the extra payments. If your gross monthly pay includes the extra payments spread over the year, the agreement’s 100% will be slightly lower than that figure. Enter your monthly pay without them in the calculator to get closer to the amount on your payslip.
