Spanish sick leave runs in calendar days, and day one is the date on the sick note, even if you had already started work that morning. For an ordinary illness starting on 2 November 2026, the first three days are unpaid, on 5 November 2026 the benefit starts at 60% paid by the employer, on 17 November 2026 the INSS or the mutua takes over and on 22 November 2026 it rises to 75%. If the leave drags on, 365 days are reached on 1 November 2027 and the INSS takes control, and the benefit ends at the latest on 29 April 2028. For a work accident everything comes forward: the benefit starts the next day and is already at 75%. Weekends and public holidays count exactly like working days.
How the days are counted
Article 173 of the General Social Security Act sets the day the benefit starts and Royal Decree 53/1980 the rate of the first band; neither mentions working days, so the calendar runs without breaks. The day the leave starts is day 1. On that basis, an ordinary illness starting on 2 November 2026 with an expected length of 60 days, ending on 31 December 2026, looks like this.
| Milestone | Day | Date |
|---|---|---|
| Pay starts at 60%, paid by the employer | 4 | 5 November 2026 |
| The INSS or mutua takes over | 16 | 17 November 2026 |
| Rate rises to 75% | 21 | 22 November 2026 |
| The INSS takes control | 365 | 1 November 2027 |
| Latest end of the benefit | 545 | 29 April 2028 |
The calculator above does the same with your own date and adds the band table, which you can use to check each month's payslip. If you want the amount and not just the dates, the full calculation is in how much sick pay.
The dates shift with the cause
For work accidents and occupational disease, the employer pays the wage for the first day and the benefit starts the next day at 75%, under article 2 of Decree 3158/1966. There are no unpaid days at all and no 60% band in between: with the same start date the table has only 2 rows. Special situations, such as disabling menstruation or week 39 of pregnancy, have their own calendar, covered in special situations. If you are self-employed there is no employer share: the mutua pays from day four.

Dates the table leaves out
Your doctor reviews the leave on dates that depend on the length estimated on the first note, under Royal Decree 625/2014: the detail is in sick notes and confirmations. If a new leave for the same condition starts within 180 days of discharge, the days are added to the earlier one and the calendar does not restart; we work it out in relapse. And if the leave reaches 545 days, the maximum length page explains the 90 days of assessment that can follow.
