The five national industrial agreements we have read mainly protect work accidents and occupational disease, and leave ordinary illness on the statutory benefit unless there is a hospital stay. Chemicals, textiles and meat processing pay 100% after a work accident; printing does so from day 5. For ordinary illness, chemicals and printing only top up with a hospital stay, and textiles and meat processing do not top up at all. Construction is a case apart: the national agreement only guarantees 100% during a hospital stay and the following 60 days, and the rest is set by each province's agreement. On 1800 euros, 30 days off after a work accident in chemicals pay €1,800, against €1,365 of benefit; for illness without a stay, €1,062.

Construction: the hospital stay and 60 days after

The general construction agreement (BOE-A-2023-19903, article 70) sets only one national top-up: 100% of base pay and the bonuses of the provincial agreement during a hospital stay and the following 60 days, for any cause, while the leave continues. The ordinary top-up for illness and accidents is set by your province's agreement, which the calculator does not know. 7th agreement, to 2026 and extendable.

On €1,800 with 10 days in hospital, a 90-day leave pays €5,100.00: the first 70 days at 100% and the rest at 75% of the base. Without a stay, the national text leaves €3,762.00.

Chemicals: accidents, occupational disease and hospital stays

The chemical industry agreement (BOE-A-2025-3083, article 37) guarantees 100% for work accidents, occupational disease, hospital stays with their recovery period, risk during pregnancy and day surgery followed by more than 15 days of recovery. The reference is base salary, the agreement bonus and personal and job supplements, without Sunday, holiday or night bonuses or incentives. Ordinary illness without a stay has no sector top-up. 21st agreement, to 2026 and extendable.

Textiles and clothing: accidents only

The textile agreement (BOE-A-2025-20177, article 42) tops up work accidents, including those on the way to or from work, and occupational disease: 100% of the previous month's gross pay, for up to 12 months. Ordinary illness stays on the statutory benefit. If your leave followed a commuting accident, see commuting accidents. 2024-2026 agreement.

Printing: from day 5

The printing, paper, cardboard and publishing agreement (BOE-A-2026-19751, article 8.6), in force from 2026 to 2029, pays 100% of the previous month's contribution base after a work accident or occupational disease, from day 5 until discharge. Days 2 to 4 are paid at the statutory 75%. For ordinary illness, 100% of pay only if there is a continuous hospital stay from day 5 onwards, and for as long as it lasts. On €1,800, 30 days after a work accident pay €1,755.00; 30 days of illness with 12 in hospital, €1,254.00.

Meat processing: the full regulatory base

The meat industry agreement (BOE-A-2025-13965, annex 18) tops up to 100% of the regulatory base after a work accident or occupational disease, minus the share of extra payments and overtime, and stops if the contract ends or the benefit moves to direct payment. Ordinary illness: only 13.848 euros per day in hospital with surgery (2025 figure). On a €1,800 base, 60 days of occupational disease pay €3,600.00, against €2,715.00 under Decree 3158/1966. 2024-2025 agreement, in force until replaced.

Common questions

What top-up does sick leave get in Spanish construction?

The national agreement only guarantees 100% while you are in hospital and for the following 60 days, if you are still on leave. The general top-up for illness and accidents is set by the provincial agreement. On 1800 euros with 10 days in hospital, a 90-day leave pays €5,100; without a stay, €3,762 under the national text.

Does the textile agreement count an accident on the way to work?

Yes. Article 42 expressly includes commuting accidents, alongside work accidents and occupational disease: 100% of the previous month's gross pay, for 12 months at most. On 1800 euros, 30 days of leave pay €1,800. Ordinary illness has no top-up under this agreement.

Can a chemicals employer withdraw my top-up over absence?

Article 36 of the chemicals agreement lets the employer withdraw any sick pay top-up it paid by custom or arrangement if your individual absence rate exceeds 3% in the quarter. It does not affect the guarantee in article 37, which covers work accidents, occupational disease and hospital stays at 100%.
