In the four national retail and customer-facing agreements, accidents are paid at 100% and illness depends on conditions. Department stores pay nothing for the first three days of each leave due to illness, unless it is the only one in the year, and from day 4 guarantee 100% of group base pay. Contract catering pays 100% for the first and second leave of the year, and from the third only from day 21. Petrol stations only top up illness with a hospital stay or if it appears on their list of serious illnesses. Pharmacies require a hospital stay or a serious illness. On 1800 euros, 30 days off sick in a department store add up to €1,620, against €1,062 from the benefit alone.

Department stores: 100% from day 4

The department store agreement (BOE-A-2023-13740, article 50) guarantees 100% of group base pay, not total pay. For ordinary illness, the first three days of each leave in the year are unpaid; if you have only one leave in the whole year, the employer pays those three days when the year closes. Days in hospital and leave for radiotherapy, chemotherapy or dialysis do not count. The top-up is limited to the delegated payment period, that is, while the employer advances the benefit. For work accidents, 100% from the first day. 2023-2026 agreement, extendable.

For an exact result, enter your group base pay in the calculator instead of your gross pay. On €1,800, 30 days off sick give €1,062.00 of benefit and €558.00 of top-up.

Contract catering: the leave count matters

The canteen and contract catering agreement (BOE-A-2025-12598, article 37) pays the first leave for illness in the year at 100% of actual pay and the second at 100% of agreement pay with supplements. From the third, the statutory benefit only, unless the leave goes past 21 days: then 100% of agreement pay from day 21. Work accidents and occupational disease are paid at 100% of actual pay. The maximum is 12 months, and the top-up ends if you leave the company. 2025 agreement, in force until the next.

Petrol stations: accident, hospital stay or serious illness

The petrol station agreement (BOE-A-2026-21085, article 59), published on 9 October 2026, separates three cases. Leave after an accident, at work or not, is paid at 100% of actual pay. Illness with a hospital stay, at 100% for the first 15 days. The serious illnesses listed in the article, at 85% of the contribution base from day 11 to 20 and 100% from day 21 to 90. Occupational disease is not mentioned. 2025-2027 agreement, published on 9 October 2026.

On €1,800, 60 days off with a listed serious illness pay €3,162.00; the same leave without one stays at €2,412.00.

Pharmacies: hospital stay or serious illness

The community pharmacy agreement (BOE-A-2022-23018, article 47) guarantees the full pay you would earn at work after a work accident. For ordinary illness, only if there is a hospital stay or a serious illness listed in Royal Decree 1148/2011, and then from the first day for up to six months. Without the qualifying period there is no top-up. 25th agreement, extended (no 26th in the BOE). On €1,800, 30 days of leave with five in hospital pay €1,800.00; without a stay, €1,062.00, the amount set by Royal Decree 53/1980.

Common questions

Will a department store pay back my first three days off sick?

Only if it is your only leave for illness in the year: the employer then pays those three days at year end. With two or more spells, days 1 to 3 of each stay unpaid. Days in hospital and leave for radiotherapy, chemotherapy or dialysis do not count towards this rule, under article 50.

What do I get in contract catering for a third leave in the year?

Article 37 leaves the third and later spells on the statutory benefit, unless they last more than 21 days: from that day, 100% of agreement pay. On 1800 euros a month, a third 30-day leave pays €1,212; the first, €1,800. The top-up lasts 12 months at most.

Does the petrol station agreement cover an accident outside work?

Yes. Article 59 speaks of temporary incapacity due to an accident without saying whether it happened at work, and guarantees 100% of actual pay. On 1800 euros, 30 days off after a fall at home pay €1,800. Ordinary illness without a hospital stay or a listed serious illness has no top-up.
