| III Convenio colectivo de ámbito estatal del sector de contact center (antes telemarketing) | Art. 70. Complementos en los supuestos de incapacidad temporal | BOE-A-2023-13741 |
Prepared by Radif Partners · Method · Rules and agreements read in the BOE on 29 October 2026
Four national business services agreements, four different rules. Contact centres pay 70% for the first three days with a cap of 9 days a year, 75% up to day 20 and 100% up to a year, and work accidents at 100% from day one. Consulting and IT, like engineering, only tops up leave longer than 30 days, and then pays 100% from day 5: a 30-day leave on a 1800 euro salary pays €1,062 and a 31-day leave €1,656. Private security applies a 50 to 100% scale on the contribution base up to day 100, with caps depending on how many times you have been off that year. In all four, once the top-up ends you receive the statutory benefit.
Contact centres: three steps and a yearly cap
The contact centre agreement, formerly telemarketing (BOE-A-2023-13741, article 70), improves every band of the law. For illness: 70% of agreement pay on days 1 to 3, capped at 9 days a year; 75% from day 4 to day 20; and 100% from day 21 until a full year of leave. With a hospital stay, 100% from day one. Work accidents are paid at 100% from day 1; occupational disease is not mentioned in the article. Agreement pay includes base salary, extra payments and the bonuses for holidays, Sundays, night work and languages. 3rd agreement, to 2026 and extendable.
On €1,800, 30 days off sick give €1,491.00; if the leave starts with a hospital stay, €1,800.00.
Consulting and IT: long leave only
The agreement for consulting, information technology and market research (BOE-A-2025-7766, article 26) does not top up leave of 30 days or fewer: you receive the statutory benefit. If the leave goes beyond 30 days, the employer pays 100% of pay from day 5 inclusive, for 12 months at most from the start of the leave. Any more favourable terms you already had are kept. 19th agreement, to 2027.
| Days of leave | Statutory benefit | With the agreement |
|---|---|---|
| 15 | €432.00 | €432.00 |
| 30 | €1,062.00 | €1,062.00 |
| 31 | €1,107.00 | €1,656.00 |
| 60 | €2,412.00 | €3,396.00 |
Engineering: the same rule, with an extension
The agreement for engineering and technical consultancies (BOE-A-2023-6346, article 29) uses the same 30-day threshold and the same start on day 5, at 100% of pay. It lasts 12 months and extends by 6 more, from day 366 to 545, if the leave extension is granted; it ends if the contract ends. 20th agreement, rolled over each year. A 60-day leave on €1,800 pays €3,396.00, of which the employer covers €984.00.

| Without leave you would have earned | €1,860 |
Private security: a scale on the base
The security companies agreement (BOE-A-2026-8569, article 51) uses the common-risk contribution base, not pay. For illness: 50% on days 1 to 3, once a year only; 80% from day 4 to 20, twice a year; 100% from day 21 to 40; 90% from 41 to 60; 80% from 61 to 90; and 80% from 91 to 100 only if you had no other leave in the previous 12 months. With a hospital stay, 100% from admission for up to 40 days. Work accidents are paid at 100% of the annex pay table plus seniority and the danger bonus. 2026-2030 agreement.
On a €1,800 base, a first 100-day leave pays €5,106.00 against €4,212.00 of statutory benefit. From day 101 you receive what Decree 3158/1966 sets: 75% of the base.
